JURISDICTION OF
OCEAN HIGHWAY AND PORT AUTHORITY
(OH&PA)

[Referred to as the Ocean Highway and Port Authority or OH&PA or simply Authority)

By a special act of the Florida Legislature, the Ocean Highway and Port Authority is an agency of the State of Florida. The Port of Fernandina Authority was originally chartered in 1941 as a body politic and governmental entity and along with amendments, revisions and legislatively approved changes since that date remains a subdivision of the State of Florida having a present day name of Ocean Highway and Port Authority operating as a Special District pursuant to section 189.429 Florida Statutes Chapter 2005-293..  As the Port’s governing body, the Port Authority has policy-making, budgeting and general oversight responsibilities for all port activities and the power to regulate and fix charges for the port facilities.

APPLICATION AND INTERPRETATION OF TARIFF

Rates, rules and regulations contained in this tariff shall apply equally to all users of the facilities on the effective date shown in this tariff and as amended. All rates and regulations in this tariff are subject to change without notice, except as may be required by law. OH&PA has extended to the Commercial Director of Nassau Terminals LLC, a subsidiary of Kinder Morgan, the right to interpret the tariff of the Port of Fernandina USA.

CONSENT TO TERMS OF TARIFF

The use of the port facilities under the jurisdiction of the Authority shall constitute a consent to all of the terms and conditions of this tariff and specifically to Chapter 311, Florida Statutes, and evidences an agreement on the part of all common carriers, vessels, their owners or agents, or other users of such terminal facilities to pay all charges specified herein, and be governed by all rules and regulations shown in this tariff and the Florida Statutes.
